Judicial E.D. -- Erecting private-developer interests as "public use" in the guise of "public purpose" changing "A man's home is his castle" to "A man's home is his sandcastle on the beach of political waves."
In the U.S. Supreme Court decision announced on June 23, 2005 [Kelo v. City of New London, 545 U.S. ___ (2005) [source] the five-justice majority (Stevens, Kennedy, Souter, Ginsburg and Breyer) stretched the Supreme Court's prior "public purpose" stretching of the "public use" requirement (imposed by the Fifth and Fourteenth Amendments) for governmental "taking" of private property beyond common-sense recognition. It borders on equating the political whims of local government (or state or federal governments, for that matter) and collaborating private interests with "public purpose" and, hence, in accordance with the Supreme Court's prior stretching of "public use" to include "public purpose," it borders on equating such whims with the mandates of the Fifth and Fourteenth amendments making "public use" a sine qua non for governmental taking of private property. This is not merely not good-- it's bad.
When the Judiciary stretches meaning of constitutional (and/or statutory) language beyond the common-sense meaning of ordinary words, it thereby adopts a cloistered, insular interpretation alienated from the common-sense world. It breeds disrespect for the Judiciary. Citizens reasonably expect, and likewise respect, highly-technical, non-commonsensical interpretations of highly technical, specialized statutory language but not such interpretations of ordinary language. "Public use" is not a highly-technical term beyond the comprehension of ordinary people with ordinary knowledge. It's not an interpretation of something as arcane as "special purpose entity" (a concept that ultimately provided the springboard for stock fraud in the 1990's)-- it's a common-sense term not requiring legal training to be understood within the constitutional meaning of the Fifth and Fourteenth Amendment.

Democrats demand that Karl Rove resign or be fored for saying post-9-11 "liberals" favored law enforcement over military strategy against terror; Rove's molehill of hyperbole versus Durbin's mountain of distortion.
Democrats are demanding
that Karl Rove resign or be fired by George Bush for saying that after 9-11,
"liberals" favored law enforcement over military strategy in combating terror. Such
demands attempt to equate Rove's molehill of hyperbole with the mountain's of shrillness by Dick
Durbin, Ted Kennedy, Howard Dean, Nancy Pelosi, and the rest of the Michael Moore wing
fuselage of the current Democratic Party in which leaders such as Joe Lieberman are being left out
in the cold.
Manners, Mountains & Molehills.
How could characterizing "liberals" as, in effect, being too much in favor of law-enforcement tactics over military strategy to combat terrorists who declared war on us be deemed by any rational person as being even remotely equivalent to Durbin's comparison of our treatment of the captives at Gitmo (where no captive has died) with the operation of death camps by the Nazis, Stalin and Pol Pot? How about equating a diet too rich in fat with a diet of cyanide?

Senate rejects McCain/Lieberman amendment to Energy Bill to codify Global Warming BSF; U.N. and European, bureaucracies (aka IPCC) apoplectic over Senate's refusal to pass gas limiting amendment.
Yesterday, the Senate rejected an amendment to the Energy Bill proposed by John McCain and Joe Lieberman that would have, in essence, codified Scientific Flatulence-- better known outside the U.N., European and Third World bureaucracies (i.e., IPCC) as the "Global Warming" theory. This proposed amendment is among a group of "Global Warming" bills introduced perennially by McCain and Lieberman, whose good intentions cannot remedy the bad science upon which such proposals are founded.
Advocates of the theory that activities of mankind, rather than natural causes, are causing fluctuations in average annual temperatures over geologically-short time-spans contend their theory is sound, but the real sound being heard is the scientific flatulence upon which such theory is based. That such theory is so obviously flawed in its premise is not new even though the media still has not caught on to (or has chosen to ignore) flaws exposed years ago. Meanwhile, we waste billions on such Scientific Flatulence while spending mere millions to develop ways to defend against a far more deadly planetary catastrophe-- i.e., the next Tunguska-size impact.

Dick Durbin says he's "sorry"; Americans respond by recognizing him as a sorry excuse for a U.S. Senator in likening Gitmo to death camps run by Nazis, Stalin and Pol Pot.
Dick Durbin, in competition with Ted Kennedy, Howard Dean and the ACLU to minimize common sense and thereby maximize danger to our troops and our war against Islamic Fanaticism, is trying to yield his current first-place position back to Ted Kennedy and the ACLU. Durbin "apologized" to "anyone who " may have been offended" by his likening Gitmo to death camps run by Nazis, Stalin and Pol Pot. (Emphasis added.)
Ostensibly, he must believe that not everyone would have been offended by such comments.
Therefore, he surely did not want to offend such un-offended people such as Michael Moore, Howard
Dean, Ted Kennedy, the ACLU, Amnesty International, the International Committee of the Red Cross
(not your father's "Red Cross"), Martin Sheen, Sean Penn, Danny Glover, Al Franken, and
the rest of the far-left wing fuselage of the
Democratic Party ad naseum.
Indeed, Durbin is merely following what has become a tradition in the far-left wing
